TERMS & CONDITIONS

It is agreed that the following terms set out the total agreement made between The Big Picture Company.Co.UK Limited and the Client and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. It is agreed that the Client in this agreement is the bride and groom and that all instructions are from the bride and groom regardless of who pays the contract value.

1. The Client is required to pay a Booking fee to secure the time and services of The Big Picture Company.Co.UK Limited for the Client's wedding. The Booking fee is non-refundable and non-transferable in the event of cancellation, it being the agreed loss suffered by The Big Picture Company.Co.UK Limited due to cancellation. No date will be secured until the Booking fee has been paid and cleared.
2. The Big Picture Company.Co.UK Limited will be the sole stills photography supplier for the Client's wedding.
3. The balance of fees on the agreed package will be paid 30 days prior to the date of the wedding secured. Payment for additional images and prints is to be made when they are ordered. The amount of the final package will depend on the Client's requirements and will be agreed between both parties before 30 days prior to the wedding.
4. The Big Picture Company.Co.UK Limited may display any photographs taken as part of this contract in its portfolio, literature, display areas, exhibitions, competitions, advertising and website.
5. The Big Picture Company.Co.UK Limited will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials. It is sometimes impossible to record the exact colour as seen by the human eye.
6. Any images or copies of images, whether stored digitally or otherwise, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Big Picture Company.Co.UK Limited in writing.
 7. The Big Picture Company.Co.UK Limited shall be granted artistic licence in relation to the poses photographed, the locations used and the number of images taken and its judgement regarding these matters shall be deemed correct. The Big Picture Company.Co.UK Limited will not be responsible for limitations enforced by the weather, church, registry office, reception venue or unwilling guests which prevent requested photographs being taken. The Big Picture Company.Co.UK Limited reserves the right to delete any images that are deemed unsuitable.
8. The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
9. In the unlikely event of the assigned photographer(s) being unable to attend the Client's wedding due to unforeseen circumstances, The Big Picture Company.Co.UK Limited reserve the right to appoint another photographer to attend and undertake the wedding photography to his/her best ability.
10. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
11. The Client may cancel this contract at any time by giving written notice to The Big Picture Company.Co.UK Limited but in doing so shall forfeit any monies paid. Should cancellation be received by The Big Picture Company.Co.UK Limited less than 10 weeks prior to the date of the wedding secured the Client shall in addition pay a sum equal to 50% of the contract value. The said sum shall be payable as compensation as an estimate of the loss The Big Picture Company.Co.UK Limited would suffer.
12. Digital files remain the property of The Big Picture Company.Co.UK Limited.
13. Any complaints should first be raised by the Client with The Big Picture Company.Co.UK Limited in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.
14. The Big Picture Company.Co.UK Limited will supply draft album layouts during the album design process for the Client to approve before producing the final album. Both parties agree to respond to design alterations in a timely manner and arrive at the agreed final version within 12 months of the wedding. If the album design is not finalised within the 12 months, and this delay is due to the Client, The Big Picture Company.Co.UK Limited reserves the right to recover from the Client any additional costs in finishing price increases. The Client is required to approve the final album version and The Big Picture Company.Co.UK Limited will not be responsible for any undesired picture choices that remain after final version approval.
